The European Commission attempted to sharpen employers Health and Safety duties by challenging the legal duty to “ensure the safety and health of workers in every aspect related to the work ….. so far as is reasonably practicable”.

The comparable EC Directive does not contain the “so far as …….” proviso.

The UK challenged the ruling and won. It is interesting to note that the UK health and safety performance record is among the best in Europe.
