Trading Standards are increasingly using powers under the Enterprise Act to seek court orders against businesses that flout consumer laws.

The Act has similar provisions to food laws, Health and Safety, Fair Trading, in that a civil court (not the criminal magistrates court) can issue an order to stop particular detrimental activities. The business will be invited to give an assurance, in the first instance, but if the law is still being flouted then an order can be sought to stop the offences.

It is only used where it can be shown the collective interests of consumers are being compromised.
