In a previous bulletin we reported that the organisation Heyday had challenged the mandatory requirement procedures in the age discrimination legislation.

A senior member of the judiciary, the Advocate General, provided an opinion in a European case that the EU directive on Equal Treatment does not apply to state laws setting requirement ages.

Whilst such an opinion does not bind a judgement on the ECJ it would be persuasive.
