London Borough of Lambeth were ordered to pay £550,000 to a park worker who was discriminated against on the grounds of disability.
A 34 year old male employee had learning difficulties.
Lambeth had a policy of selecting employees for redundancy which focused on the number of days of absence and whether they drove a car or not, both of which discriminated against the employee.
The award covered loss of earnings until retirement.
Employers need to give careful consideration as to whether policies on aspects such as retirement can discriminate on the various aspects such as retirement can discriminate on the various aspects caught by discrimination legislation.
