The Secretary of State for Trade and Industry has allowed an appeal by Swan Garage (Bosham) Limited against the revocation of its consumer credit licence following advice from an independent tribunal. Swan Garage (Bosham) Limited has three car sales sites in the Chichester area.
Swan Garage appealed to the Secretary of State after the Office of Fair Trading (OFT) decided in December 2002 that it was not a "fit person" to hold a licence under the Consumer Credit Act 1974. The OFT's decision was based largely on the company's convictions under consumer protection legislation. The Secretary of State appointed a tribunal to hear the appeal and it found that the the company's business practices had changed radically for the better since the OFT made its decision.
